1. About these Terms

These Terms and Conditions ("Terms") govern your purchase and use of Bookupost, a social media scheduling and messaging software platform, and your use of bookupost.com (the "Site"). Bookupost is owned and operated by Get Seen, LLC ("Bookupost," "we," "us," or "our").

By creating an account, purchasing a license, or using the Site or the software (together, the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not purchase or use the Service. If you use the Service on behalf of a business, you confirm you have authority to bind that business, and "you" includes that business.

2. Your Lifetime License

What you buy. A one-time payment gets you a non-exclusive, non-transferable, revocable license to access and use Bookupost under these Terms. You are buying access to hosted software, not ownership of the software, its code, or our servers. No monthly or annual subscription fee applies to the plan you purchase.

What "lifetime" means. "Lifetime" means the operational life of the Bookupost product, not the life of the purchaser. Your access continues for as long as we operate Bookupost (or a successor product we provide to existing license holders), unless your license ends earlier under Section 7. If we ever permanently discontinue Bookupost, we will give at least 90 days' notice by email so you can export your content.

Updates. Your license includes updates and improvements we release to the lifetime plan at no extra charge. We may, at our discretion, offer separate add-ons, services, or products in the future that are not part of the lifetime plan; you are never required to buy them.

Fair use. "Unlimited" accounts, posts, and scheduling mean we do not set a fixed cap for normal personal, business, or agency use. To keep the Service stable for everyone, we may apply reasonable limits on activity that is excessive or automated beyond normal use, such as unusual API volume, storage far beyond typical users, or activity that harms system performance. Where practical, we will contact you before applying a limit. Platform-imposed limits (see Section 4) also apply.

One license per purchase. A license may not be resold, sublicensed, shared publicly, or transferred to another person or business without our written consent. You may give team members access through the Service's team features.

3. Accounts and Teams

Eligibility. You must be at least 18 years old and able to form a binding contract to purchase or use the Service.

Your account. You agree to give accurate information when you sign up and keep it current. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at info@getseen.net if you suspect unauthorized access.

Team members and groups. The Service lets you invite team members, assign roles, and organize connected social accounts into groups (for example, one group per client). You are responsible for who you invite, the permissions you give them, and their compliance with these Terms. If you manage accounts for clients, you confirm you have your clients' authorization to connect, post to, and message from their accounts.

4. Third-Party Platforms, Messaging, and AI

Connected platforms. Bookupost connects to third-party services such as Facebook, Instagram, WhatsApp, X, YouTube, TikTok, LinkedIn, Threads, Pinterest, Reddit, Telegram, Google Business Profile, Google Drive, OneDrive, and Dropbox. These platforms are not operated by us. Your use of each is governed by that platform's own terms and policies, which you agree to follow.

Platforms can change or withdraw their APIs, posting rules, rate limits, or features at any time. When that happens, a Bookupost feature for that platform may change, become limited, or stop working. We will make reasonable efforts to adapt, but we do not guarantee that any specific platform or integration will remain available, and such changes are not grounds for a refund outside the period in Section 6. We are not responsible for a platform suspending, restricting, or banning your accounts.

AI features. The Service includes AI tools that suggest ideas, draft captions, generate content, and can reply to comments and direct messages automatically if you turn that on. AI output can be inaccurate, incomplete, or inappropriate. You are responsible for reviewing AI-generated content before publishing, for any automated replies you enable, and for making sure the content follows the law and platform rules. AI features may be powered by third-party providers, and their availability may change.

5. Your Content and Acceptable Use

Your content. You own the posts, images, videos, captions, messages, contact lists, and other material you upload or create through the Service ("Your Content"). You give us a limited license to host, store, process, format, and transmit Your Content only as needed to run the Service, including publishing it to the platforms you select. You confirm you have the rights to Your Content, including any music, images, logos, or likenesses in it.

You are responsible for keeping your own copies of important content. Watermarking is a tool you choose to apply; we are not responsible for protecting Your Content from copying by others.

6. Payment, Refunds, and Support

Payment. The price shown at checkout is a one-time payment in U.S. dollars. Prices and promotional offers may change at any time, but changes do not affect licenses already purchased. You are responsible for any taxes that apply to your purchase. Third-party costs, such as fees charged by Meta for WhatsApp Business messaging, are separate and paid by you to that provider.

30-day money-back guarantee. If you are not satisfied, you may request a full refund within 30 days of your purchase date by emailing info@getseen.net or contacting support. No reason is required. Refunds go to your original payment method, and your license and access end once the refund is issued. After 30 days, all payments are final and non-refundable, except where the law requires otherwise. We may decline refund requests that show clear abuse, such as repeated purchase-and-refund cycles.

Chargebacks. If you dispute a charge with your bank instead of using our refund process, we may suspend your account while the dispute is open.

Changes to features. We continually improve Bookupost, so features may be added, changed, or removed over time. Feature descriptions on the Site are a general overview, not a guarantee that any specific feature will be offered permanently or will work identically on every platform.

Support. License holders get access to our member support portal (including onboarding, video training, and updates) and in-app live chat with AI assistance and the option to reach a live agent. We aim to respond within a reasonable time but do not guarantee specific response times.

7. Legal Protections

Our intellectual property. The Service, the Site, and all software, designs, text, graphics, logos, training materials, and the Bookupost name are owned by Get Seen, LLC or its licensors. Except for the license in Section 2, these Terms give you no rights to them. Third-party names and logos shown on the Site belong to their respective owners.

Feedback. If you send us ideas or suggestions, we may use them without obligation to you.

Privacy. How we collect and use personal information is described in our Privacy Policy. When you upload contact lists or message data about other people, you are responsible for having a lawful basis to do so.

No guarantee of results. Bookupost is a tool. We do not guarantee any particular reach, engagement, followers, leads, sales, or other business results.

Disclaimer of warranties. The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or that scheduled posts or messages will always publish on time, since delivery depends on third-party platforms.

Limitation of liability. To the fullest extent the law allows, Get Seen, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, or for actions taken by third-party platforms. Our total liability for any claim relating to the Service will not exceed the amount you paid us for your Bookupost license.

Indemnification. You agree to defend, indemnify, and hold harmless Get Seen, LLC and its owners, employees, and contractors from claims, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, the messages you send, your use of the Service, or your breach of these Terms or any law.

Suspension and termination. You may stop using the Service at any time. We may suspend or terminate your account, without refund, if you materially breach these Terms, violate the acceptable use or messaging rules, abuse the Service, or if required by law. Where reasonable, we will give notice and a chance to fix the issue first. On termination, your license ends and we may delete your data after a reasonable period. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

8. General Terms

Governing law. These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in King County, Washington, and you consent to their jurisdiction. Before filing any claim, both parties agree to first try to resolve the dispute informally by contacting the other in writing and allowing 30 days to work it out.

Changes to these Terms. We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date, and for material changes we will notify license holders by email or in the app. Continued use of the Service after changes take effect means you accept them.

Other terms. These Terms and our Privacy Policy are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the business, and your license will carry over.
